These Terms of Service (“Terms”) govern the use of the hosting services and related products (“Services”) provided by SkyWeb – Tecnologias de Informação, Unipessoal LDA, a company registered in Portugal with VAT No. 513303804 and registered address at Avenida do Brasil nº1, 9º Andar, 1749-008 Lisboa, Portugal (“SkyWeb”, “we”, “us”, “our”). By purchasing, accessing, or using our Services, you (“Customer”, “you”, “your”) agree to be bound by these Terms. If you do not agree, you must not use our Services.

1. Eligibility and Account Registration

1.1 You must be at least 18 years old to use our Services.
1.2 You agree to provide accurate and complete account information and to keep it updated.
1.3 You are responsible for all activities conducted under your account.
1.4 We reserve the right to refuse service at our discretion.

2. Provision of Services

2.1 SkyWeb provides web hosting and related services on a best-effort basis.
2.2 Services are provided on a shared infrastructure unless otherwise stated.
2.3 We may modify, update, or discontinue Services where necessary to maintain operations or compliance.
2.4 Access to Services may be affected by scheduled or emergency maintenance.

3. Acceptable Use

3.1 You agree to use our Services in compliance with all applicable laws and our Acceptable Use Policy (AUP)
3.2 Prohibited activities include, but are not limited to:

  • sending unsolicited bulk email (spam)
  • hosting malware or phishing content
  • copyright or trademark infringement
  • illegal, harmful, or fraudulent content
  • network abuse or denial-of-service attacks
  • activities causing excessive resource use

3.3 We reserve the right to suspend or terminate Services for AUP violations.
3.4 You are solely responsible for the content you host.

4. DMCA and Copyright Complaints

4.1 We comply with the U.S. Digital Millennium Copyright Act (“DMCA”).
4.2 Copyright complaints must be submitted as described in our DMCA Policy.
4.3 Upon receipt of a valid notice, we may disable or remove content.
4.4 Repeat infringement may result in account termination
4.5 Counter-notices are accepted in accordance with applicable law.

5. Customer Responsibilities

5.1 You are responsible for maintaining backups of your data.
5.2 You must secure your login credentials.
5.3 You must ensure compliance with applicable data protection and privacy laws.

6. Billing and Payment

6.1 All Services are billed in advance unless otherwise stated.
6.2 Payment is due by the invoice due date.
6.3 Failure to pay may result in suspension or termination.
6.4 Prices may change, and notice will be provided in advance for recurring services.
6.5 You are responsible for any applicable taxes.

7. Refund Policy

7.1 Hosting plans include a 30-day money-back guarantee.
7.2 The following items are non-refundable:

  • domain registration and renewal fees
  • SSL certificates
  • licensing fees
  • setup or administrative fees (if applicable)
  • VPS, dedicated servers, or custom services
  • services terminated for policy violations

7.3 Refunds after 30 days are not available unless required by law.
7.4 Refunds are issued to the original payment method only.

8. Data, Backups, and Security

8.1 Unless explicitly included, backups are not guaranteed.
8.2 You are responsible for maintaining copies of your data.
8.3 We are not liable for data loss, corruption, or unauthorized access unless caused by our negligence.

9. Service Suspension and Termination

We may suspend or terminate Services where:

  • payment is overdue
  • there is suspected abuse or illegal activity
  • your use harms our systems or other customers
  • required by law or regulation

Upon termination, your data may be deleted.

10. Service Availability and Uptime

10.1 While we strive for high availability, uptime is not guaranteed unless stated in writing.
10.2 We are not responsible for outages beyond our reasonable control.

11. Liability and Indemnity

11.1 You use the Services at your own risk.
11.2 To the maximum extent permitted by law:

  • Services are provided “as-is” and “as available”
  • we disclaim all warranties, express or implied
  • our total liability is limited to the fees paid for the 12 months prior to the claim

11.3 You agree to indemnify and hold SkyWeb harmless from claims arising from your use of the Services.

12. Personal Data and Privacy

12.1 Our processing of personal data is governed by our Privacy Policy.
12.2 We comply with the EU General Data Protection Regulation (GDPR).

13. Third-Party Services

Some Services rely on third-party providers. We are not responsible for their actions, availability, or policies.

14. Changes to Terms

We may update these Terms at any time. Continued use of the Services constitutes acceptance of updated Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Portugal.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Portugal.
